Terms and Conditions

  1. The Model agrees to provide her services to Diane Lowe Promotions or Dlp Models Ltd (dlp) and act and perform such duties for the clients of  dlp as may be required by dlp to the best of their skill and ability.

  2. The model understands that motor racing can be dangerous despite all reasonable precautions being taken. All persons present at any race meeting for whatsoever purpose are there at their own risk and this also applies to all models attending. dlp will not be liable for loss or injury sustained by any person whilst at any motorsport venue however caused.

  3. The Model will agree to give dlp (and where necessary any dlp client) accurate replies to all questions put to them concerning their experience/qualification and other personal data relevant to assessing their suitability for appointment.

  4. The Model agrees to attend the Client for training and instruction if required.

  5. The Model confirms that he/she has authority to enter into an Agreement with dlp and that he/she is not bound by any previous agreement which adversely affects this Agreement.

  6. The model agrees that registration shall be deemed not to create any partnership or employment relationship between dlp and the Model.

  7. Other than in instances where dlp is required by law to deduct Tax or National Insurance the Model confirms that he/she be responsible for their own personal insurance, National Insurance and, Income Tax arising out of this agreement.

  8. dlp agrees to pay the Model the agreed fee for satisfactory completion of an assignment. The model must invoice dlp within 7 days of the end of an assignment. Expenses will only be reimbursed where they have been approved in writing in advance by dlp and claims are invoiced to dlp within 7 days of completion of the assignment and accompanied by original VAT receipts.

  9. If so requested by the Client the Model may be required to work overtime (i.e. any period in excess of an Assignment dates and times specified). All overtime must be authorised by dlp in advance in writing and will be paid at the rates agreed.

  10. Any uniforms belonging to a Client must be returned to dlp immediately upon completion of an Assignment. The cost of any outfit, or part thereof, damaged or otherwise not returned will be deducted from the Model's fee.

  11. The Model's appearance and presentation must be of the highest standard for the duration of an assignment. The Model must not act in any manner which may harm or adversely prejudice the reputation of dlp or the Client or put themselves or dlp or the client in breach of any relevant Health and Safety Regulations

  12. If dlp receives any justifiable complaint from the Client concerning the conduct of the Model during the performance of an Assignment, dlp reserves the right to cancel the Assignment Agreement and to pay to the Model such proportion of the fee (if any) which relates to the satisfactory performance of the Assignment only.

  13. The Model shall indemnify and hold harmless dlp against all liabilities, claims, demands, actions, costs, damages and losses arising out of any breach by the Model of any terms of this Agreement, or, arising directly or indirectly out of any act or omission of the Model in performance of an Assignment.

  14. dlp reserve the right to cancel an Assignment Agreement for any reason and dlp shall not be liable for any claim, damage or loss which may be suffered by the Model directly or indirectly as a result of such cancellation.

  15. In the event that an Assignment cannot be performed or its obligations fulfilled for any reason beyond the reasonable control of dlp, including cancellation by the Client less than 14 days before the commencement date, then such non-performance or failure to fulfill the obligation shall be deemed not to be a breach of an Assignment Agreement. In any event, dlp will provide the Model with as much advance notice as possible.

  16. Any payment which may be made by dlp to the Model following cancellation of the Assignment by the Client will be made at the sole discretion of dlp as a sign of goodwill only and shall not be deemed to be a waiver of any of dlp's rights arising under this Agreement of otherwise.

  17. In the event that a Client becomes bankrupt or goes into liquidation, DLP are not liable to pay any monies owed to the Model in respect of that client other than a pro rata application of funds as received by dlp, neither will DLP be liable for any legal costs the Model may incur as a result.

  18. Cancellation or amendment of an Assignment Agreement by a model will only be agreed by dlp if notification is received in writing no less than 48 hours before the commencement of the Assignment. Failure to advise dlp will result in a fine being levied on the model to compensate dlp for any additional costs arising on the assignment as a result.

  19. If the Model is unable to complete an Assignment due to ill health, where a medical certificate will be required, or any other reason he/she must notify dlp immediately. Failure to give timely notice or provide a medical certificate will be treated as a model cancellation and clause 18 compensation will apply.

  20. Where, whether arising under an Assignment Agreement or otherwise, the Assignment is only partly performed by the Model, dlp reserve the right at the sole discretion of dlp, to pay to the Model such proportion of the fee for that part of an Assignment which has been properly performed.

  21. The Model must not at any time substitute him/herself for another or transfer any obligations under an Assignment Agreement or any of its rights or obligations without prior written authority from dlp.

  22. The terms of an Assignment Agreement and/or any grievance the Model may feel he/she has under it, shall be confidential between dlp and the Model and shall not be disclosed to or discussed with any third party including the client.

  23. The Model undertakes that he/she will not approach or contact, directly or indirectly, any dlp Client with a view to obtaining any employment or obtain any employment with dlp client without the prior written consent of dlp.
